1. HOW TO ENTER
a. The METALLICA’S ROADTRIP TO DEATH... MAGNETIC.contest (the “Contest”) will begin on October 6, 2008 at approximately 10am Pacific Time (“PT”) and end on October 31, 2008 at approximately 5pm PT (the “Contest Period”).
b. To participate in the contest, you may enter via the following method(s): On-air: Starting on October 6, 2008 at approximately 10am any time a Metallica song is played, caller 10 to 702-791-1075 will be qualified to win that week’s prize, pending verification of eligibility. On Fridays approximately 5pm one (1) winner from that week’s qualifiers will be selected at random to win that week’s trip for two. At the time of their call, each caller will be required to give his or her first and last name, complete address including zip code, telephone number, and date of birth. In the event that the selected caller is disconnected, the next caller that successfully makes it through on the call in line and complete their call will be considered that qualifier.
c. There is no limit to the number of times a listener may be a qualifier in this Contest.
2. ELIGIBILITY RESTRICTIONS
a. The contest is open to all KXTE listeners who are 21 years of age or older and who legally reside in Las Vegas metropolitan area including Clark County Nevada. Employees of KXTE (the “Station”), its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Las Vegas metropolitan area and the members of their immediate families are ineligible to participate or win.
b. Only one winner per household is permitted in any Station contest.
c. Winners must have a credit card and valid government issued photo identification

WEEK #2:. METALLICA CONCERT IN FRESNO, CA INCLUDES 1 NIGHT HOTEL STAY (DOUBLE STANDARD OCCUPANCY), TICKETS FOR THE CONCERT ON AT THE SAVE MART ARENA 12/13/08 AND $200 GAS CARD. APPROXIMATE RETAIL VALUE: $1000.00.
WEEK #3 : METALLICA CONCERT IN SAN DIEGO, CA. INCLUDES 1 NIGHT HOTEL STAY (DOUBLE STANDARD OCCUPANCY), TICKETS FOR THE CONCERT AT THE COX ARENA ON 12/15/08 AND $200 GAS CARD. APPROXIMATE RETAIL VALUE:
WEEK #4: METALLICA CONCERT IN LOS ANGELES, CA. INCLUDES 1 NIGHT HOTEL STAY (DOUBLE STANDARD OCCUPANCY), TICKETS FOR THE CONCERT AT THE FORUM ON 12/17/08 AND $200 GAS CARD. APPROXIMATE RETAIL VALUE:
b. Travel arrangements must be made through Station’s agent on a carrier of Station’s choice. No prize substitutions, cash equivalent, or transfer of prizes permitted except at the sole discretion of the Station. Prize subject to availability and the Station reserves the right, at their sole discretion, to award a prize of greater or equal value if the advertised prize is unavailable. If a winner cannot travel on dates specified by Station, that winner may be disqualified and no alternate winner will be drawn. All other costs not specifically stated herein, including, but not limited to, taxes, meals, tips and ground transportation, are the responsibility of each winner. Taxes are solely the responsibility of the winners. Each winner and his or her travel companion must travel on the same itinerary and are responsible for obtaining all required travel documents. In addition, the travel companion of each winner must be 18 years of age or older. Each winner may be required to present a valid credit card upon hotel check in to cover any incidental expenses incurred during their stay. Each winner and his or her travel companion are responsible for obtaining travel insurance (and all other forms of insurance) where applicable, at their option, and hereby acknowledge that the Station has not and will not obtain or provide travel insurance or any other form of insurance. Each winner his or her travel companion must sign a Publicity, Liability Waiver and Travel Release form prior to traveling. If a selected event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason beyond the control of the Station, the Station’s sole responsibility to a Winner will be to award the remaining available portion of the prize and no substitution will be provided for unawarded portion of prize. Tickets are subject to terms and conditions as specified by issuer. Seat locations (when applicable) are to be determined by the Station. The Station reserves the right remove or to deny entry to a winner and/or guest if he/she engages in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the concert or festival.
c. All prizes or prize certificates may be picked up at the office of the Station at the address below. The winner will forfeit any prize or prize certificate not claimed within fifteen (15) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
d. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of the Station management with respect to the contest are final.
b. On Friday October 10, 2008 during the 5pm hour one winner will be selected at random from all the qualifiers received during the week 10/6/08-10/10/08 to win Week #1 prize.
c. On Friday October 17, 2008 during the 5pm hour one winner will be selected at random from all the qualifiers received during the week 10/13/08-10/17/08 to win Week #2 prize.
d. On Friday October 24, 2008 during the 5pm hour one winner will be selected at random from all the qualifiers received during the week 10/20/08-10/24/08 to win Week #3 prize.
e. On Friday October 31, 2008 during the 5pm hour one winner will be selected at random from all the qualifiers received during the week 10/27/08-10/31/08 to win Week #4 prize.
f. The odds of being a qualifier will depend on the number and order of calls received.
g. You must listen to be a qualifier, however, each WEEKLY WINNER DOES NOT NEED TO LISTEN TO WIN.
h. Winners will be contacted via telephone at approximately 5pm on each Friday during the contest. In the event the winner cannot be contacted at that time, KXTE will attempt to contact the winner again on the following Monday approximately 11am. If the winner does not respond within 24 hours of the second attempt, an alternate winner will be selected by random drawing from all remaining qualifiers and will be notified by phone.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. The Station reserves the right to make changes in the rules of the contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.
e. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of the Station.
f. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.
g. Copies of the written contest rules and a list of winners (when complete) are available during regular business hours at the main studio of KXTE. 6655 West Sahara Avenue, Suite D-110 Las Vegas, NV 89146, or by sending a self-addressed, stamped envelope to KXTE.
